Your Auto Insurance and a California DUI

According information given by the California Department of Motor Vehicles, as of January 1, 2007, if you request an out-of-house / public driving record printout, any DUI offense on your record will appear for 10 years from the violation date.

Under this new law, DUI’s that had previously been taken off a person’s driving record have now been put back on. For example if you had a DUI back in 1998 and had it removed from your record 2005, and had since received a good driver discount, under the new law, the DUI would be back on your driving history and you may not qualify for a good driver discount again until 2008.

Many insurance companies check your motor vehicle record only once every three years or when you’re applying for a new policy. Sometimes, accidents, tickets, and drunk-driving convictions can escape your insurer’s attention or don’t end up on your motor vehicle record. However, if your insurer does find out about a driving under the influence (DUI) conviction, you’re likely to feel the pinch of higher rates and possibly policy cancellation or non-renewal. Shopping around will definitely yield the lowest rate, as they vary greatly.

There are two ways insurance companies generally deal with customers convicted of DUI. First, your insurer will likely raise your car insurance premiums and label you a high-risk driver if it finds out you’ve been convicted of DUI.

Second, your auto insurer may cancel your insurance mid-term or terminate the policy at the end of the term because of your DUI conviction, especially if you are currently in a preferred class. Your company will send you a notice stating why you’ve been canceled, and then you’ll have to find another insurer while having a cancellation on your claims history and a DUI on your driving record.

What is auto insurance? Auto insurance (or car insurance, motor insurance) is insurance consumers can purchase for cars, trucks, and other vehicles. Its primary use is to provide protection against losses incurred. By buying auto insurance, depending on the type of coverage purchased, the consumer may be protected against:

* The cost of repairing the vehicle following an accident

* The cost of purchasing a new vehicle if it is stolen or damaged beyond economic repair

* Legal liability claims against the driver or owner of the vehicle following the vehicle causing damage or injury to a third party.

Liability insurance covers only the last point, while comprehensive insurance covers all three. Even comprehensive insurance, however, doesn’t fully cover the risk associated with buying a new car. Due to the sharp decline in value immediately following purchase, there is generally a period in which the remaining car payments exceed the compensation the insurer will pay for a “totaled” (destroyed, or written-off) vehicle. So-called GAP insurance was established in the early 1980’s to provide protection to consumers based upon buying and market trends. The escalating price of cars, extended term auto loans, and the increasing popularity of leasing gave birth to GAP protection. GAP waivers provide protection for consumers when a “gap” exists between the actual value of their vehicle and the amount of money owed to the bank or leasing company. In some countries including New Zealand and Australia market structures mean that people are more likely to buy a nearly new car than a new car so this is less of a problem.

In the United States, liability insurance covers claims against the policy holder and generally, any other operator of the insured’s vehicle, provided they do not live at the same address as the policy holder and are not specifically excluded on the policy. In the case of those living at the same address, they must specifically be covered on the policy. Thus it is necessary for example, when a family member comes of driving age they must be added on to the policy. Liability insurance generally does not protect the policy holder if they operate any vehicles other than their own. When you drive a vehicle owned by another party, you are covered under that party’s policy. Non-owners policies may be offered that would cover an insured on any vehicle they drive. This coverage is available only to those who do not own their own vehicle.

Generally, liability coverage does extend when you rent a car. However, in most cases only liability applies. Any additional coverage, such as comprehensive policies, i.e. “full coverage” may not apply. Full coverage premiums are based on, among other factors, the value of the insured’s vehicle. This coverage may not apply to rental cars because the insurance company does not want to assume responsibility for a claim greater than the value of the insured’s vehicle, assuming that a rental car may be worth more than the insured’s vehicle. Some states, such as Minnesota, may require that it extend to rental cars. Most rental car companies offer insurance to cover damage to the rental vehicle. In some regions, the costs associated with not having access to the vehicle (”Loss of Use”) is also covered.

However, if they have an accident and totaled their vehicle, the insurance company will only pay them the wholesale value of the vehicle. The amount they would receive could be $1000 or less. A vehicle that old just needs the insurance that protects the other person in case of an accident.

Another method to save more on your insurance is by combining your vehicles and other insurance together to get you additional savings. All insurance companies offer a multi-car discount (if yours doesnt, its time to switch companies). Further, many will discount more if you have your homeowners or renters policy with them.

There are a few other discounts that you may not be taking advantage of. It seems obvious, but make sure you are getting the correct rate for your age. Optional Covers

There are different levels of insurance available depending on what risks you wants to cover. You can cover against the costs of repairing your vehicle after an accident. You can cover the cost of purchasing a new car should yours be stolen or damaged beyond repair. These are optional covers.

Liability insurance on the other hand is compulsory for all drivers. This will cover the risk of claims being made against you as the driver or owner of the vehicle that caused damage to the property of another, the vehicle of another, for medical expenses of others injured as a result of an accident, including passengers in your car. If you have liability insurance, it will only cover these risks. If you have comprehensive insurance it will cover also the risks to yourself and your own vehicle.

GAP Insurance

However, even comprehensive insurance will not fully cover your risks. First of all there is the issue that, as soon as you buy a new car, its price suddenly drops significantly because it is no longer new. It is used. So if you were to destroy your car the day after buying it, the insurance company would likely assess the value as something less than what you paid for it, even though you may still owe a good deal more than that in payments and financing.

To cover the chances of this happening, so called GAP insurance was developed. This covers the difference in the actual value of your car, and the amount you still owe in payments. The growth of vehicle leasing has also led to GAP insurance becoming more important.

Extra Cover

In the US, the insurance policy will generally cover the owner of the vehicle and any others who drive the vehicle so long as they do not live at the same address. For those living at the same address, you should have them specifically added to your insurance policy for an extra fee. This means that if you crash someone elses car, while driving it with their permission, you will be covered by their policy, not your own. Non-owner policies are available to cover you on other peoples cars but these will only be available if you do not own your own car.
